The e-commerce website of www.artofsense.be, established in Antwerp, Belgium, VAT BE0801.658.973, offers also its customers the opportunity to purchase the products from its webshop online.

These General Terms and Conditions (“Terms”) apply to any order placed by a visitor to this e-commerce website (“Customer”).

Placing an order via the www.artofsense.be webstore implies that the customer has consulted these conditions and expressly accepts the applicability of these conditions, to the exclusion of all other conditions. Additional conditions of the customer are excluded, unless they have been expressly accepted in advance, in writing and by artofsense.be.

Article 2: Price

All prices stated are expressed in EURO, always including VAT and all other duties or taxes required by the customer.

If delivery, reservation, or administrative costs are charged, this will be stated separately. Shipping costs for Belgium and the Netherlands are € 7 to 3 kilos and above € 70 the shipping for Belgium is free.

The price statement refers exclusively to the articles as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.

Article 3: Offer

Article 4: Online purchases

Description order procedure

The customer can choose between the following payment methods:

The products/services offered through this artofsense.be e-commerce website constitute an offer subject to the condition of acceptance by artofsense.be

Artofsense.be is entitled to refuse an order (in writing) due to a serious shortcoming of the customer regarding the order or any other order or agreement in which the customer is involved.

Article 5(a): Delivery and performance of the agreement

Goods that are in stock will be sent on Monday evening and Thursday evening after receipt of payment. Articles ordered through this webshop are delivered in the BENELUX France, Germany, and Europe.

Delivery is made via BPOST or Post.nl

Unless otherwise agreed, the goods are delivered to the customer’s place of residence within 30 days of receipt of the order.

Any visible damage and/or qualitative shortcoming of an article or other shortcomings in the delivery must be reported immediately by the customer with a photo to contact@artofsense.be.

The risk due to loss or damage passes to the customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the customer upon delivery to the carrier, if the carrier has been instructed by the customer to transport the goods and this choice was not offered by Art of Sense.

The delivered items remain the exclusive property of artofsense.be until full payment by the customer

The customer undertakes, if necessary, to point out to third parties the retention of title of Art of Sense, e.g., to anyone who would seize the items not yet fully paid for.

Article 7: Right of withdrawal

The provisions of this article only apply to customers who purchase items online from artofsense.be in their capacity as consumers.

If the right of withdrawal applies:

The customer has the right to withdraw from the agreement within a period of 14 calendar days without stating reasons.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the good.

In order to exercise the right of withdrawal, the customer must inform Art of Sense of his decision to withdraw from the contract by an unambiguous statement (e.g., in writing by post or e-mail).

If you offer the consumer the option of completing and sending information about the withdrawal of the contract electronically via your website, you must insert the following text: complete and send via our website www.artofsense.be.

If the customer makes use of this option, we will immediately send the customer a confirmation of receipt of his withdrawal on a durable data carrier (e.g. by e-mail).

In order to comply with the withdrawal period, the customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.

The customer must return or hand over the goods without delay, but in any case, no later than 14 calendar days after the day on which he communicated his decision to withdraw from the agreement to ART OF SENSE.

The direct costs of returning the goods shall be borne by the customer.

If the returned product is in any way diminished in value, ART OF SENSE reserves the right to hold the customer liable and claim compensation for any loss in value of the goods resulting from the use of the goods by the Customer that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be returned.

If the customer has requested that the provision of services be started during the withdrawal period, the customer will pay an amount that is proportional to what has already been delivered at the time of notifying us that he is withdrawing from the contract, compared to the full performance of the agreement.”

If the customer withdraws from the agreement, ART OF SENSE will refund all payments received from the customer up to that point, including the cost for the standard delivery costs, to the customer within a maximum of 14 calendar days after ART OF SENSE has been informed of the decision. of the customer to withdraw from the agreement. In the case of sales contracts, ART OF SENSE can withhold reimbursement until it has received all the goods back, or until the customer has demonstrated that he has returned the goods, whichever comes first.

Any additional costs because of the customer’s choice of delivery method other than the cheapest standard delivery offered by ART OF SENSE will not be refunded.

ART OF SENSE refunds the customer with the same payment method with which the customer performed the original transaction, unless the customer has expressly agreed otherwise; in any event, the customer will not be charged for such reimbursement.
